What happens when a tree falls and hits your home? What happens when a tree from your property falls and hits a neighbor's home? Who owns the Tree? Does it really matter?
These are the questions we want to answer BEFORE THE TREE FALLS.
Here it is in a nutshell: If the tree falls and hits your home, YOUR own home insurance will pay the clam for property damages (less your deductible). If your tree falls and hits a neighbor's home, THEIR home insurance would pay, because the claim happened on their property. So, ultimately, each property owner is responsible for damage to their own property regardless of who owns the tree.
Always be sure to do your best to manage the risk here. If there is an existing tree on your property you may want to:
- remove the tree (eliminate the risk) if it is located close to your home, garage or other structure, or
- trim the tree (reduce the risk)
If the tree is on a neighboring property you can communicate with the property owner your concern of a possible fall due to high winds or heavy rain. You may ultimately still be responsible for costs if the the tree hits your home, but perhaps the neighbor will take action prior to an incident.
